This week, on the 21st May, saw Reg 4 celebrate its 15th birthday.
Good old Regulation 4, The Duty to Manage Asbestos in Non-domestic premises.
It was laid out in the Control of Asbestos at Work Regulations (CAWR) 2002 on 21st November 2002 with Reg4 given an 18 month lead-in period, coming into force on 21st May 2004.
So 15 years ago it became law for all non-domestic premises, built before the year 2000, to have an Asbestos Management Plan, including a register of ACMs.
Yet how many still don’t?
Or how many have got an old Type 2 survey and that’s it, no further action taken. A survey gives you full compliance after all doesn’t it? NO.
Sadly, there are still so many people who either have no idea or they think they’re fully compliant but they’re not.
And this means they’re at higher risk of exposure incidents which clearly goes against the intended outcome of complying with the law which is, of course, prevent exposure and reduce/prevent deaths.
